<p>Obviously, if you have had an accident, and you are reading all of this advice, it may have been a few hours since the accident. However, if you ever have another accident, or if it’s only been a few hours since you were hurt, here’s what you should do from the start.</p>

<p>First, take a look around and determine if you or anyone, are hurt. If so, taking steps like trying to prevent further injury or loss of blood are the most important thing you can do. Even if some other driver caused you to be injured, it’s just good manners to help the other driver if they are hurt. They may even be so thankful that they admit their fault to you. The worst thing you can do is get angry or start a fight.</p>

<p>Second, make sure everyone is safe from being injured further. If you are in the middle of traffic, and you are dizzy, sit down away from traffic. If your vehicle is a traffic hazard and you have accident warning devices like flares or triangles, put them out on the road to warn other drivers and get away from the car. Let the police an other emergency personnel investigate the scene with the vehicles in place and move them more safely at a later point.</p>

<p>Third, call the police. Accident reports are extremely helpful if the police will do such a report. Let the police know you are injured immediately. Answer the police questions honestly. <p>Fourth, get the other driver’s information including their names, addresses, driver’s license numbers, make and model of their vehicles, license plate numbers, and their insurance company name and policy number. If there are witnesses, get their names, addresses and telephone numbers as well. If the other driver makes any admissions of fault, write those down as well.</p>

<p>Fifth, if you have a camera on your cell phone or in the car and you aren’t too injured, take some photos of the vehicles and the scene. If you can’t do it right away, do it after you are released from the hospital.</p>

<p>Sixth, if you are hurt, obtain medical treatment. Don’t decline the ambulance or hospital examination to save your insurance company money or to be stoic. Take your valuables out of your car if you can and get checked out at the hospital. If you are not hurt, don’t get treatment you don’t need. However, remember, after an accident, you may feel a rush of adrenaline that causes you to only start feeling symptoms of pain a few hours later. If you have a health plan that requires you to obtain permission first, call them and find out where you are allowed to seek treatment.</p>

<p>In Daubert v. Merrell Dow Pharmaceuticals Inc., 509 U.S. 579 (1993), the Supreme Court overhauled the standards for admitting expert witness testimony in federal court by removing &#8220;junk science&#8221; from the courtroom and introducing a new reliability test for the permissibility of expert theory and technique. </p>
<p>It would seem the consequence of the ruling would drive attorneys to ensure their expert&#8217;s work is solidly founded in the principles of the science from which it is based. The irony is that Daubert seems to have had more of an influence on the frequency and techniques that attorneys use to challenge opposing expert&#8217;s testimony instead of verifying the science being used.</p>
<p>According to the 2005 national Guideline study which surveyed 140 scientific experts to determine if Daubert had an affect on lawyers use of expert witnesses, the prevailing strategy seems to be focused on discrediting an opponent&#8217;s expert rather than bolstering the credibility of its own expert. In addition, Daubert does not seem to have triggered considerable changes to the level of rigor used in checking an expert&#8217;s background before being engaged. Overall, it appears that Daubert has not resulted in significant alterations in preparing and presenting expert testimony, but has definitely influenced the frequency and intensity of expert testimony challenges. </p>
<p>The Daubert factors themselves, as well as the trend in using them to prevent admission of expert testimony, is an indication that lawyers should take the time and effort to better understand the science of their cases, which will benefit them through:<br />
 &#8211; Identifying appropriate and qualified experts  &#8211; Evaluating the work product of experts  &#8211; &#8220;Daubert proofing&#8221; experts  &#8211; Challenging opposing experts </p>
<p>Expert Credentials Challenged More Often </p>
<p>Experts feel that the opposing side is challenging their credentials and testimony more often since the Daubert ruling, with 54% agreeing, 24% neutral and only 21% disagreeing. </p>
<p>These results confirm what has been reported earlier that in the wake of Daubert &#8211; expert opinion and credentials are challenged more often and more vigorously. However, when experts were asked if attorneys were asking them to assist in challenging the opposing counsel&#8217;s expert testimony more often, only 34% of experts agreed with 43% disagreeing and 25% remaining neutral.</p>
<p>This indicates that many attorneys challenge the credibility of the opposing side&#8217;s expert(s) without the direct assistance of their own expert(s). They may be using their own expert&#8217;s reports and affidavits to challenge the opposing counsel&#8217;s experts, but they don&#8217;t appear to be asking their own experts to directly assist them in doing so. Many lawyers advise otherwise and indicate that experts should be made part of the litigation team. </p>
<p>Lawyers Aren&#8217;t Fully Using the Science </p>
<p>According to the article &#8220;Focus On Science, Not Checklists&#8221; in the December 1, 2003 issue of Trial written by Bert Black, &#8220;lawyers either refuse to or simply cannot learn the science well enough to &#8216;tell the scientific story&#8217;. Instead they fall back on what lawyers do best: They search for legal precedents and try to capture science in just the right checklist of [Daubert] factors.&#8221; </p>
<p>To determine if experts have been specifically asked to modify or change their opinions or reports to better comply with the Daubert requirements, Guideline asked experts if attorneys require them to:<br />
 &#8211; Add citations to references that support their theories / opinions<br />
 &#8211; Demonstrate their theories/opinions are accepted in the relevant <br />
scientific/technical/engineering communities<br />
 &#8211; Show their theory/opinion was developed by independent work and not expressly for the purpose of the litigation in which they have been involved<br />
 &#8211; Demonstrate that their opinions do not drift far from the science or evidence </p>
<p>Only a slight majority (56%) indicated that they had been asked to make such changes or additions. Those that had were evenly split in the four areas listed above. Since the remaining experts (44%) have not been asked to meet the above Daubert factors, it is a possible indication that a large segment of lawyers are still not taking the time to fully understand and use the science involved in their cases. Instead, they are likely relying on precedent as indicated by Black.</p>
<p>Expert Background Checks Unaffected </p>
<p>Experts were roughly split into thirds on whether lawyers have been conducting more thorough checks of their backgrounds with 31% agreeing, 34% feeling things have remained the same and 35% disagreeing. This mixed response indicates that Daubert has not significantly influenced the rigor used in conducting expert background checks. </p>
<p>No Change in &#8220;Teaching&#8221; Judges &#38; Juries</p>
<p>Most experts feel that things have remained the same in their role as teachers of science and technology to lawyers, judges and juries. Guideline questioned experts if they are being asked to provide detailed explanations of science, technology and/or engineering to lawyers, judges or juries more often and 51% disagreed with that statement. Only 18% agreed with the statement and the remaining 30% were neutral. It appears that Daubert has not had an impact on the teaching role of scientific and technical expert witnesses.</p>
<p>Abramowitz and Bohrer noted a similar trend in their New York Law Journal article of May 6, 2003, &#8220;White-Collar Crime.&#8221; In the article they state, &#8220;Daubert does not appear to have resulted in a notable change in the type of expert testimony seen in federal court&#8230;but, Daubert has brought about a radical transformation in the procedures for using and challenging expert testimony.&#8221; </p>
<p>Expert Witness Consulting Growing </p>
<p>Over the past 10 years, 73% of the surveyed experts indicated their expert witness work has either stayed the same or increased and this matches the general growth trend of litigation in the United States. The main reason given for increased business was word-of-mouth referrals. Other reasons included:<br />
 &#8211; Growth in litigation<br />
 &#8211; Personal sales and marketing efforts<br />
 &#8211; Demand for a particular expertise</p>
<p>Only 27% of experts indicated a decline in expert witness business. The most often cited reason for the decline was intentionally not pursuing or purposely avoiding expert witness work. </p>
<p>The intention of Daubert is to keep &#8220;junk science&#8221; out of the courtroom. That may or may not be working, but it certainly has not had an impact on expert witness consulting as experts indicated their business in this area has been constant or continues to grow.</p>
<p>Product Liability Leads the Pack </p>
<p>Product liability is the area that scientific, technical and engineering experts are asked to assist with most often, followed by intellectual property and personal injury. According to LexisNexis, product liability cases have surged since 2001. This and the increasing complexity of today&#8217;s products likely contribute to the use of scientific and technical experts in product liability and patent litigation as well.</p>

<p>The importance that exercise plays in the health of the individual is now universally recognized. Everyone should be incorporating exercise into their life as a regular part of their life routine. Exercise improves a person&#8217;s outlook on life and raises their sense of well being. This eliminates any desire to reach for a drug to artificially improve how you feel in life. It is, to put it succinctly, any exercise that you will enjoy doing regularly. People often ask fitness advisors what piece of equipment they should buy to work out on. Well, the correct answer is the one you will enjoy using and thus will use consistently and regularly. For example one person might enjoy a rowing machine in their home, while another might enjoy a treadmill. While, again, another might enjoy using a climber or stair-like workout piece of equipment. People have different tastes, and that must be recognized and acted upon. Just because your friend has an exercise bike at home, doesn&#8217;t mean you should get one instead of say, an elliptical trainer that you would find more fun. </p>

You probably have noticed that there are television sets in fitness centers. This strategy can easily be applied within your home. So have the equipment right there in your television room, and get on it whenever you watch television. In fact, a sedentary life style created by people spending hours sitting in front of a TV can be totally turned around, so that watching TV becomes the thing that propels you along the new path of getting a lot of exercise into your life. You don&#8217;t even have to go to a gym, you don&#8217;t even have to go outside, and you don&#8217;t even have to set aside extra time, just do it while you are watching your favorite TV programs in your own home.</p>
<p>Of course, you can also get good exercise and fresh air at the same time with an outside exercise such as walking, jogging or biking. However, you should only do these if you enjoy them. Since running can leave some people with wear and tear injury because of its impact nature, walking is more highly recommended because it is much safer. </p>
<p>It might surprise some of you that I believe that strength training is equally as important to good health as aerobic exercise. Doing aerobic exercise can improve the strength of your muscles, but only up to a certain point because a particular aerobic exercise will provide only so much resistance, so that after awhile, you are only maintaining the muscle you have already developed and not building any more muscle. The value of strength training for the health of every individual is becoming more and more recognized in the fitness world. It is now accepted that working out with heavy resistance provides benefits far beyond just being stronger and looking better. </p>
<p>Today using heavier resistance, moving at very very slow tempos, in both directions, and quickly reaching the point of failure, when you just cannot move the resistance any longer, is considered the best form of strength training. At the moment when your body tries but cannot overcome and move the resistance any longer, your muscle will signal your body to stimulate muscle growth to increase your muscle&#8217;s strength, and also improve the metabolic functions employed in the use of your muscles, so that any future challenge can be more easily met. Maintaining a slow rate of movement in both directions eliminates the effects of momentum, and counters the effects of gravity as the weight inside the workout machine is being lowered. This system of slow training with heavy resistance creates a more intense and productive workout while lessening any potential injury to the body, both through the very slow speed of movement and the reduced number of repetitions. This is the form of strength training I recommend, both to achieve the results you desire and protect you from any injuries. Because of the large increase of the resistance you will be dealing with, this method of working out is best done only using exercise machines, rather them free weights. In addition, proper form must be maintained at all times, both to prevent injury and insure you will get a proper workout that will provide all the benefits that are intended. When people hurry through their strength training by doing many rushed repetitions instead of going slowly, and jerk the weight, twist their body, clench their teeth and hold their breath, they are doing wrong things that will only keep them from making good progress in a safe way. I want to further reiterate that no matter what type of weight training you do, it is essential that you breathe freely and never ever hold your breath.</p>
<p>The positive side of this increased effort from using much heavier resistance, and slower and fewer repetitions in your fitness center&#8217;s machines, is that your sessions working out can be much much shorter in duration.  With this new method that is more and more recognized as the best way to train, you can be finished with your complete workout in a surprisingly short time while achieving better results than you might have experienced the regular way. Strength training this way strengthens your bones, improves your cardiovascular health, improves your flexibility, makes your joints more stable and less prone to injury, and by improving your metabolism, helps you replace fat with muscle! Your added muscle will make everything in life easier to do and make you feel more energetic, thus, raising your spirit and mood. </p>
<p>Some people promote weight training as the complete answer to becoming and staying fit and insist that there is no additional need to be active.  The truth is that even were you to work out with very heavy weights a couple of times a week, if you aren&#8217;t staying active the rest of the week you will not be able to maintain your health. The reason for this is that an integral part of keeping yourself healthy and young is the working of your body&#8217;s lymphatic system. Unfortunately this aspect of staying healthy has not received the attention it really deserves. This system is particularly important for the health of anyone in recovery since its main role is detoxification. Most people who have abused drugs have taken in and inundated their body&#8217;s systems with toxins. It is very important for those in recovery to do all that they are able to remove these substances from their bodies as quickly and thoroughly as possible. And then, because of a need to continue to feel and be healthy to stay away from drugs, those in recovery should remain on a program that keeps their bodies detoxified and clean. </p>
<p>The lymphatic system is the metabolic cleanser of the body. It draws in and carries toward disposal the many substances that need to be removed for the cleansing and detoxification of the body&#8217;s systems, including toxins, dead cells, cancer cells, nitrogenous wastes,  fatty globules, pathogenic bacteria, infectious viruses, foreign substances, heavy metals, and other waste byproducts that the cells give off. However unlike the blood&#8217;s circulatory system which has the heart to pump the blood through its system, the lymph system lacks a pump to move the lymph fluid with all its waste through its many capillaries and ducts toward disposal. <p>Sometimes when a plaintiff settles a case for a large sum of money, the defendant, the plaintiff&#8217;s attorney, or a financial planner consulted in association with the settlement, will propose paying the settlement in installments over time rather than in a single lump sum. When a settlement is paid in this manner it is called a &#8220;structured settlement&#8221;. Often the structured settlement will be created through the purchase of one or more annuities, which guarantee the future payments.</p>
<p>A structured settlement can provide for payment in pretty much any schedule the parties choose. For example, the settlement may be paid in annual installments over a number of years, or it may be paid in periodic lump sums every few years.</p>
<p><a></a>Potential Disadvantages of Structured Settlements</p>
<p>Some people who enter into structured settlements feel trapped by the periodic payments. They may wish to purchase a new home, or other expensive item, yet be unable to muster the resources because they can&#8217;t borrow against future payments under their settlement.</p>
<p>Some people will do better by accepting a lump sum settlement, and investing it themselves. Many standard investments will give a greater long-term return than the annuities used in structured settlements. </p>
<p><a></a>Selling a Structured Settlement</p>
<p>If you have a structured settlement, you may have been approached by a company interested in purchasing your settlement, or may be curious about <a href="http://structuredsettlementalliance.net/" target="_self">selling your settlement</a> in return for a lump sum buyout. About two thirds of states have enacted laws which restict the sale of structured settlements, and tax-free structured settlements are also subject to federal restrictions on their sale to a third party. As a consequence, depending upon where you live and the terms of your annuities, it may not be possible for you to sell your settlement.</p>
<p>Keep in mind that companies which buy structured settlements intend to profit from their purchase, and sometimes their offers may seem quite low. You may benefit from approaching more than one company in relation to the sale of your settlement, to make sure that you obtain the highest payoff. You also want to be sure that the company which wants to buy your settlement is established, well-funded, and reputable &#8211; you don&#8217;t want a fly-by-night outfit to obtain the rights to your annuities but to disappear or go bankrupt before paying you the buyout money. You may have to go to court to get a judge to approve the buyout. It is usually a good idea to consult with a lawyer before entering into an agreement to sell your settlement.</p>
<p><a>Special Considerations</a></p>
<p>Any person entering into a structured settlement should be on guard for potential exploitation in relation to the settlement:</p>
<p><strong>Excessive Commissions</strong> &#8211; Annuities can be highly profitable for insurance companies, and they often carry very large commissions. It is important to ensure that the commissions charged in setting up a structured settlement don&#8217;t consume an inappropriate percentage of its principal.</p>
<p><strong>Overstated Value</strong> &#8211; Sometimes, after negotiating a particular settlement figure, the defense will overstate the value of a structured settlement. As a result the plaintiff, in accepting the settlement, in fact obtains a significantly lower dollar value than was agreed upon. Some defendants have nominally paid the full amount of the settlement, knowing that they would later obtain significant rebates from the annuity companies they used. Plaintiffs should consider compariing the fees and commissions charged for similar settlement packages by a variety of insurance companies, to make sure that they are in fact getting full value. A plaintiff may wish to make it a condition of the settlement that the defendant will actually pay the full value of the settlement in setting up the structured settlement, and that any rebates received by the defendant for annuities included in the settlement be payable to the plaintiff.</p>
<p><strong>Self-Dealing</strong> &#8211; There have been cases where the plaintiff&#8217;s lawyer is also in the insurance business, and sets up a structured settlement on behalf of a client without disclosing that the attorney is purchasing the annuities from his own business, or is pocketing a large commission on the annuities. Similarly, there have been situations where the plaintiff&#8217;s attorney has referred the client to a particular financial planner to set up a structured settlement, without disclosing that the financial planner will be paying the attorney a referral fee in relation to the client&#8217;s account. Make sure that you know what financial interest, if any, your lawyer has in relation to any financial services sold or recommended by the lawyer.</p>
<p><strong>Life Expectancy</strong> &#8211; It is unfortunate, but many people who receive large personal injury or workers&#8217; compensation settlements will have a shortened life expectancy as a result of their injuries. It is important to consider life expectancy in association with any structured settlement, and to consider whether it is appropriate to enter into an annuity where payments will cease upon death. Sometimes it will make sense to insist upon an annuity that pays a minimum number of payments, or one that will pay a balance into the plaintiff&#8217;s estate, such that the value of the settlement is not lost to an insurance company upon the plaintiff&#8217;s untimely death.</p>
